This Privacy Policy explains how Policy Guard LLC ("Policy Guard," "we," "us," or "our") collects, uses, stores, and protects your personal information when you use our services at www.mypolicyguard.com, through our mobile applications, or through any related platforms or integrations.

By using our services, you agree to the practices described in this Privacy Policy. If you do not agree with any part of this policy, you should not use the Service.

Policy Guard is a life insurance policy information storage and beneficiary notification service. We are not an insurance company, financial advisor, or legal advisor. This Privacy Policy applies solely to information collected through the Policy Guard Service.

2. Information We Collect

2.1 Information You Provide

When you create an account or use our Service, we may collect the following:

  • Account details: your name, email address, phone number, and mailing address

  • Payment information: credit card or billing details, which are securely handled by our third-party payment processor and are not stored on Policy Guard servers

  • Life insurance policy information you choose to store within your Policy Guard account

  • Beneficiary information: the name, contact information, and relationship of your designated beneficiary or beneficiaries

2.2 Information Collected Automatically

When you access or use our Service, we may automatically collect certain technical information, including:

  • Log data: IP address, browser type, device type, pages visited, date and time stamps, and system configuration information

  • Cookies and similar tracking technologies that remember your preferences, login status, and display settings. You may disable cookies through your browser settings, though some features of the Service may not function properly as a result.

2.3 Information from Public Sources

In connection with providing the Service, Policy Guard may access publicly available sources such as obituary listings and other publicly accessible records, for the limited purpose of helping identify when a member may have passed. Policy Guard does not guarantee the accuracy or completeness of any publicly available information and relies on such information only as one of several inputs in providing the Service.

3. How We Use Your Information

Policy Guard uses the information we collect for the following purposes:

  • To create and maintain your account

  • To store your life insurance policy information securely on your behalf

  • To monitor publicly available records and attempt to identify when a member may have passed, for the purpose of notifying designated beneficiaries

  • To make reasonable efforts to contact your designated beneficiaries and provide them with your stored policy details and claims guidance, upon becoming aware of a potential passing

  • To process your subscription payments and send billing-related communications

  • To respond to your questions, requests, and customer support inquiries

  • To send service-related notices and administrative communications

  • To improve, maintain, and protect the Service

  • To comply with applicable laws and legal obligations

Policy Guard does not use your information for targeted advertising, profiling, or any purpose unrelated to delivering the Service described in our Terms and Conditions.

4. How We Share Your Information

We Do Not Sell Your Information. Ever.

Policy Guard will never sell, rent, trade, or otherwise transfer your personal information to any third party for commercial purposes. We share your information only in the following limited circumstances:

4.1 With Your Designated Beneficiaries

Upon becoming aware of a potential passing, Policy Guard will share your stored policy information with the beneficiary or beneficiaries you have designated in your account. This is the core function of the Service and is done solely on your behalf and at your direction.

4.2 With Service Providers

We work with trusted third-party companies to help us operate the Service, including payment processing, data storage, and technical infrastructure. These providers are permitted to use your information only to perform services on our behalf and are bound by confidentiality obligations.

4.3 As Required by Law

We may disclose your information when required by law, court order, or governmental authority, or where we believe disclosure is necessary to prevent fraud, protect the safety of any person, or protect the rights and property of Policy Guard. Where legally permitted, we will notify you before disclosing your information to any governmental authority.

4.4 In Connection with a Business Transfer

If Policy Guard is acquired, merged with, or otherwise transferred to another entity, your information may be transferred as part of that transaction. We will notify you in advance and explain your choices if this occurs.

4.5 Aggregated and De-Identified Data

We may share aggregated, anonymized, or de-identified information that cannot reasonably be used to identify you. This data may be used for research, analytics, or service improvement purposes.

5. Data Security

Policy Guard takes the security of your personal information seriously. We implement commercially reasonable administrative, technical, and physical safeguards designed to protect your data from unauthorized access, disclosure, alteration, or destruction.

Your payment information is handled exclusively by our third-party payment processor and is not stored on Policy Guard servers. All data transmitted through our Service is protected using industry-standard encryption protocols.

However, no method of electronic transmission or storage is completely secure. While we work hard to protect your information, we cannot guarantee absolute security. If you have concerns about the security of your account, please contact us at support@mypolicyguard.com.

6. Data Breach Notification

In the event of a data breach that affects your personal information, Policy Guard will:

  • Investigate and contain the breach as quickly as possible

  • Notify affected members via email within 72 hours of discovering the breach, where feasible

  • Provide information about what data was affected and the steps we are taking in response

  • Offer guidance on steps you can take to protect yourself

  • Report to appropriate regulatory authorities as required by applicable law

7. Data Retention

Policy Guard retains your personal information for as long as your account is active or as necessary to provide the Service. After account deletion, we may retain certain information as required to comply with legal obligations, resolve disputes, or enforce our agreements.

Upon account deletion:

  • Your account access is terminated immediately

  • Your stored policy information and personal data are permanently deleted from active systems within thirty (30) days

  • Some data may remain in encrypted backups for up to ninety (90) days for disaster recovery purposes, after which it is permanently deleted

  • Transaction records required for tax or accounting purposes may be retained for up to seven (7) years as required by law

  • De-identified usage data may be retained for analytics purposes

8. Account Deletion

You may request deletion of your Policy Guard account at any time by:

  • Using the "Delete Account" option within your account settings

  • Emailing us at support@mypolicyguard.com with your deletion request

Please note that account deletion does not entitle you to a refund of any subscription fees already paid. Please refer to our Terms and Conditions for our full refund policy. If you have an active subscription, your subscription must be cancelled before or at the time of account deletion.

9. Your Privacy Rights

Regardless of where you live, you have the following rights with respect to your personal information:

  • Access your personal information at any time through your account settings

  • Update or correct inaccurate information in your account

  • Request deletion of your account and personal data

  • Opt out of marketing and promotional communications at any time

  • Know what information we collect and how it is used

  • Object to any sale of your data — which we do not do under any circumstances

10. State-Specific Privacy Rights

10.1 California, Virginia, Colorado, Connecticut, and Utah Residents

If you are a resident of one of these states, you have additional privacy rights under applicable state law, including the right to:

  • Confirm whether Policy Guard processes your personal information

  • Access and receive a copy of your personal information

  • Correct inaccuracies in your personal information

  • Request deletion of your personal information

  • Opt out of targeted advertising — which Policy Guard does not engage in

  • Not be discriminated against for exercising any of your privacy rights

To exercise any of these rights, please contact us using the information provided in Section 14 of this Privacy Policy.

10.2 Nevada Residents

Nevada law provides residents with the right to opt out of the sale of certain personal information. Policy Guard does not sell your personal information. If you are a Nevada resident and wish to submit a formal opt-out request, please email us at support@mypolicyguard.com with the subject line "Nevada Privacy Opt-Out."

10.3 European Union Residents (GDPR)

Policy Guard supports the principles of the General Data Protection Regulation (GDPR). If you are located in the European Union, you have rights including the right to access, rectify, erase, restrict processing of, and port your personal data. You also have the right to lodge a complaint with your local data protection authority.

By using the Service from within the EU, you consent to your information being transferred to and processed in the United States. Policy Guard will handle your data in accordance with applicable GDPR requirements to the greatest extent possible under U.S. law.

11. Cookies and Tracking Technologies

Policy Guard uses cookies and similar technologies to maintain your session, remember your preferences, and improve the Service. Cookies are small data files stored on your device.

You may disable cookies through your browser settings at any time. Please note that disabling cookies may affect the functionality of certain features of the Service. For more information on managing cookies, visit www.aboutcookies.org.

Policy Guard does not use cookies for targeted advertising or cross-site tracking purposes.

Policy Guard does not currently respond to "Do Not Track" signals from web browsers. You may still manage your cookie preferences through your browser settings as described above.

12. SMS and Text Message Communications

If you provide your mobile phone number and opt in to receive SMS communications from Policy Guard, you may receive the following types of messages:

  • Account notifications and security alerts

  • Service updates and important announcements

  • Subscription and renewal reminders

  • Promotional offers and marketing messages (only if you have opted in)

Message frequency is approximately 2 to 4 messages per month and may vary. Standard message and data rates from your mobile carrier may apply. Policy Guard does not charge separately for SMS messages.

To opt out of SMS communications, reply STOP, CANCEL, UNSUBSCRIBE, END, QUIT, or STOPALL to any text message. You will receive one confirmation message and will then receive no further marketing SMS messages. You may still receive critical account security notifications where permitted by law.

To opt back in, text START to our number or update your preferences in your account settings. For help, reply HELP to any message or contact us at support@mypolicyguard.com.

13. Children's Privacy

The Policy Guard Service is intended for adults only. Our Service is not directed to anyone under the age of 18, and we do not knowingly collect personal information from children under the age of 13. If you are a parent or guardian and believe your child has provided personal information to Policy Guard without your consent, please contact us immediately at support@mypolicyguard.com. We will promptly delete any such information upon verification.

14. Data Transfers and Storage

Your information is stored on secure servers located in the United States. If you access the Service from outside the United States, your information will be transferred to, processed, and stored in the United States, where data protection laws may differ from those in your country. By using our Service, you consent to this transfer and processing.

15. Third-Party Links and Services

The Policy Guard website and Service may contain links to third-party websites or services. Policy Guard is not responsible for the privacy practices or content of any third-party sites. We encourage you to review the privacy policies of any external websites or services you access through or in connection with the Policy Guard Service.

Third-party services used by Policy Guard may include payment processing and technical infrastructure providers. These providers are subject to their own privacy policies and are bound by confidentiality agreements with Policy Guard.

16. Changes to This Privacy Policy

Policy Guard reserves the right to update or modify this Privacy Policy at any time. If we make material changes that reduce your privacy rights or significantly affect how we use your information, we will notify you by email and post the updated policy on our website with a revised effective date. Continued use of the Service after any changes constitutes your acceptance of the updated Privacy Policy.

We encourage you to review this Privacy Policy periodically to stay informed about how we protect your information.
